Heads up for those racing in Las Vegas...

    Just so everyone knows, July 1, 2009, Nevada implemented a permit requirement for any rigs hauling race cars.

    Here's a quote from the Nevada DOT web site:

    "Out-of state commercial vehicles with a Combined Gross Vehicle Weight Rating of 10,001 pounds or more are now required to get registration permits. (Fuel permits are not required for vehicles under 26,001 pounds unless the vehicle has three axles.)
    All carriers must obtain their permit(s) before entering the state. You may no longer travel to the first available vendor."

    In the Q&A they say a pick up truck hauling a race car or horse trailer if you are doing it for prize money is considered commercial and is required to have a permit. Fine for first offense is $500.

    So what is the latest on this situation within the state of Nevada? Do we know of anyone that has actually been pulled over and cited for not having the permit? Or anyone that has purchased it been asked to show it?

    We're heading over to the bullring near the old dragstrip to run the vintage sprint car in a few weeks and I'm curious if this has been an issue for anyone yet.

    We could argue if stopped that this car is for exhibition since they don't run for a purse. But if the officer is unwilling to listen and just sees a number on the car in the trailer, I suppose we could get popped which then I'd have to go to THEIR court to fight it.

    So any stories yet?

    They want you to get a permit to Maybe win MONEY, lol that is a good one good thing they aren't asking if you turn a profit ... HaHa after fuel costs and entry fees you "profit" would be ??

    too funny are they trying to keep sportsman racers away ?.... Tourism .... maybe the racers will spend some money in Nevada .... interesting concept .

    Nice to see the Americian politicians have their heads in the same place as the Canadian politicians ... all the way up their .... oh never mind ... I'm back now , down off the soap box .

    No, I'm pretty sure they have good security at the track and they'd catch him before he got back to his rig (I don't think running is one of his strengths)...oh wait a minute...I get it now, you're saying that Randy's car is going to win the event at Las Vegas (again)...is that it?

    Here's the latest that I've found on the deal.

    Below is a response from the Commercial Training Coordinator at the Nevada Highway Patrol regarding the Federal Exception for racing under §390.3. If income is claimed as ordinary income or expenses are deducted on a Federal tax return, the vehicle is not exempt under this section. “Corporate Sponsorship” as noted in subsection 2 is referring to major corporations such as Budweiser, Coca Cola, etc.

    The DMV is not responsible for anyone who claims to be exempt under this section, which is later found to be participating in a professional or business capacity. If additional evidence determines the purpose to be commercial and the driver did not obtain the proper registration and/or fuel trip permits, they will still be subject to any applicable criminal and administrative fines.

    Question 21: Does the exemption in §390.3(f)(3) for the "occasional transportation of personal property by individuals not for compensation nor in the furtherance of a commercial enterprise" apply to persons who occasionally use CMV to transport cars, boats, horses, etc., to races, tournaments, shows or similar events, even if prize money is offered at these events?

    Guidance: The exemption would apply to this kind of transportation, provided: (1) The underlying activities are not undertaken for profit, i.e., (a) prize money is declared as ordinary income for tax purposes, and (b) the cost of the underlying activities is not deducted as a business expense for tax purposes; and, where relevant; (2) corporate sponsorship is not involved. Drivers must confer with their State of licensure to determine the licensing provisions to which they are subject.

    That's great info Mike, but my question remains the same.

    Are they actually enforcing it? Has anyone from the motorsports community that we know of been stopped and asked for said permit?

    I just want to know if this one is on their "radar" or if the Nevada Highway Patrol even know about it.
